THE JUDICIAL SYSTEM – A TOOL OF IMPLEMENTING REPRESSIVE AND PUNITIVE POLICY OF SOVIET UKRAINE 1920-1930’S.

Abstract

The article examines the role of the judiciary of USSR 1920-1930’s., which provided implementation of the totalitarian regime in society by being sentenced to severe penalties. History and painful experience confirms the need for radical changes in modern judiciary. The aim of the study is to examine the works of scientists to objectively highlight historical and legal aspects of development and the political and legal implications of the judicial system of Soviet Ukraine 1920-1930 biennium. Applied following methods: historical and legal methods of analysis and synthesis, and other general scientific and special methods. Disclosed is not the perfection of the law in the judicial system of totalitarian power, namely the nonobservance of procedural rights. We know that the level of democracy is determined by the court and role in the system of government. At present, Ukraine inherited the judicial system, based on authoritarian principles under which a person’s life and health, honor and dignity, integrity and security of the hostages were state-government interests. To consider the proposed issue presents information about the extremely harsh sentences handed down by Soviet courts in the 1920-1930’s.
